Joe Biden is about to create havoc for Donald Trump on his way out the door.
According to reports, Biden is going to hand green lobbyists a huge win while at the same time landing a crippling blow against Trump.
Reports are breaking that Biden will permanently ban new offshore drilling leases, and there is nothing that Trump can do to stop him.
Uh Oh…
Biden is going to use the Outer Continental Shelf Lands Act to back his executive order.
Sadly, once Biden issues the order, there is nothing that Trump can do to stop it.
We know this because Donald Trump fought against an order that was issued by Barack Obama using the same legislation.
The fight was litigated, and the courts stated that since the legislation had no clause allowing another president to undo the order, the only way it could be reversed was if Congress legislated it.
Donald Trump actually used this order when he was in office to extend a moratorium on offshore projects off the coast of Florida for an additional 10 years (that order expires in June 2032).
At the time Trump issued the order, he stated, “This protects your beautiful gulf and your beautiful ocean, and it will for a long time to come.”
Of course, Trump took flack for it because he has properties in or near both areas (Trump lives in Florida and has another course in North Carolina).
As far as the Obama-era order, it was issued to protect areas of the Arctic Ocean, which Trump challenged and lost in 2019.
The presiding judge in the case was U.S. District Court Judge Sharon Gleason, a Barack Obama-appointed judge, so Trump’s case was lost before it got started.
Biden is expected to announce the ban on Monday, so we will have a lot more information on this during the week.
