In what seems like an eternity ago, Judge Aileen Cannon dropped the classified documents case against Donald Trump.
The story was dominating headlines until the Trump assassination and Biden withdrawal from the presidential election.
Special Counsel Jack Smith has finally responded, filing his appeal of her decision.

As I stated in previous reports on this, I was stunned when Cannon used Thomas’s opinion in the Supreme Court immunity ruling to toss this case out.
Per Title 28, Chapter VI, Part 600, § 600.1, the authority of the Attorney General to appoint independent counsel to oversee an investigation is laid out.
This has not been challenged since it was put into play roughly two decades ago, and if the Cannon decision holds, it could create a bit of a sh**storm for the DOJ.
Basically, if Cannon is right, that means that every special counsel that has been appointed since would have been illegal, so any charges filed and convictions obtained would have to be looked at again.
Back to this case… Smith filed his appeal with the 11th Circuit Appellate Court, which is already creating the need for safe spaces on the left.
The reason is that Donald Trump appointed half the members of that panel, but that literally means nothing.
The 11th Circuit has ruled against Trump in previous cases, so don’t expect any special favors from the bench in this one.
My gut tells me that Smith will win this appeal, but there could be something to the case that we don’t know, which could be why Cannon threw the case out.
Generally, I have no problem making a guess, but this entire case has been a wild card from the outset, so I think I will just let this one play out without making a prediction.
