Border Patrol Chief Raul Ortiz was shocked when he got the order to release illegals into America’s heartland. He had never imagined the day would come and he certainly had never seen anything remotely like it in the 31 years he’s been on the job. Slowly, details have been trickling out of the deposition he gave in a Florida lawsuit back in May. The transcript was leaked to Fox recently.
Release all the excess
During a deposition recorded on July 28, Border Patrol Chief Raul Ortiz testified under oath that he was shocked by an internal Customs and Border Patrol guidance memo passed out in May. It cleared “border agents to release illegal migrants into the interior of the U.S.”
At the time, they were expecting Title 42 would be officially terminated almost immediately. Though temporarily blocked in the courts, the Donald Trump era regulation is doomed to be revoked soon.
Florida Attorney General Ashley Moody filed suit against the Department of Homeland Security and other border agencies. The release order is only one of the controversial points raised in her lawsuit. At his interrogation, Ortiz was handed a document marked Exhibit 3. The memo had been signed May 19, 2022 and was titled “Noncitizen releases from U.S. Border Patrol Custody.”

As reported by Fox, this “emergency memo predicts that border agents would not be able to process and transport large numbers of illegal aliens who would cross the southern border into the U.S. if the Title 42 public health order, which is currently stuck in limbo in court, is repealed.”
The guidance says it only kicks in when “Immigration and Customs Enforcement (ICE)/Enforcement and Removal Operations (ERO) are unable to accept custody of noncitizens due to lack of bed space.” Joe Biden’s handlers know full well that current capacity will be totally overwhelmed in about 10 minutes.
They officially expect 18,000 new citizens migrating in each and every day, while supplies last. Once the maximum shelter occupancy limit gets hit, the order says release all the rest straight into the wild. It doesn’t matter what they’re infected with or whether they’re a terrorist or not. “Noncitizens must be released directly from USBP custody to avoid overcrowding and excessive time in custody.”
Community they were caught in
After they worked through the basic details for the record, lawyers with the Florida AG’s office started quizzing Ortiz about the memo and he admitted that yes, he signed off on it, the day it was dated. Yes, it discusses the release of non-citizen from custody.
When the attorney quizzed “in your experience 31 years with the Border Patrol, have you ever seen a document—or have you ever seen a memorandum like Exhibit 3 before?” Ortiz simply replied, “No.” He also agreed that the memo “deals with the possible rescission of Title 42.” Alejandro Mayorkas has been insisting he has a plan but won’t actually tell anyone what it is. This appears to be it.
“And if ICE were either unwilling or unable to accept transfer of aliens, this memo authorizes the sectors to release aliens into the interior of the United States?” the prosecutor probed. “Well,” Ortiz qualified, “it authorizes them to release them into the communities that they were apprehended in.”
He’s under oath and wanted to speak carefully. If they’re let loose in El Paso, they can turn up in Portland days later. Florida is convinced along with the flood of invading immigrants, “smugglers will seek to take advantage of and profit from vulnerable migrants.” It won’t be too bad for drug sales either.
The important part, the legal team clarified, is that the memo does “authorize the release of aliens that would otherwise be inadmissible into the United States.” That got another simple “Yes.” According to the lawsuit filed by Florida, that’s the only solution which the Biden regime can come up with. Mass “releases of illegal migrants into the interior of the U.S.”
AG Moody notes, the “Biden administration’s failed immigration policies are disastrous. Expecting to be overrun, Biden’s Border Patrol drafted a plan to hunker down and allow inadmissible immigrants to flood into the country. But for the efforts of our office and other responsibly minded, public-safety oriented attorneys general, Title 42 would have been repealed and Biden would have released untold thousands of additional immigrants into the interior of our country—outrageous!“
