A case is now before the Supreme Court that is likely to set the liberal world on fire.
The court is hearing a Tennessee case that centers around transitional care for youth.
The state introduced a ban on such treatment, but the Biden administration and the parents of several trans children have challenged the law.
Be Reasonable
The state banned the treatments, saying that the risks were too high for children who wanted to detransition later on.
Needless to say, the liberal justices on the court don’t see that as a problem.
Leading the way was Justice Sotomayor, who likened transition drugs to aspirin, stating that all medications have risks.
The Biden administration says the new law violated the Constitution’s guarantee of equal protection.
Tennessee argued that the law was not gender specific, and that it was to protect all youth, so it would be left in place.
The conservative members of the court have often pushed back on cases such as this, saying they belong before the state legislature, not judges, and that seems to be where they are leaning here.
For instance, Chief Justice Roberts responded, “We’re not the best situated to address issues like that.”
To me, Roberts is the key to all this because, usually, one or two of Trump’s justices will follow him over the line if he crosses it.
My gut tells me Roberts will deny the appeal, and the law will remain in place, leaving it up to the Tennessee legislature to make changes if need be.
And that, of course, is going to create a meltdown on the left, which seems intent on allowing children too young to drive or be left alone in the home to decide they want to change their gender.
