We often hear about people being able to purchase guns legally that should have been flagged during the FBI background check.
It would appear that Secretary Mayorkas is partly to blame for that.
The DHS Inspector General has released a report that will surely be put atop the stack of impeachment documents the GOP is putting together for Mayorkas.
No Oversight
This is a massive failure on the part of Mayorkas.
The report from the IG stated, “If NICS examiners do not receive disposition data to deny or approve a firearm sale within 3 business days, licensed sellers may transfer firearms at their discretion.
“Therefore, DHS not sending disposition data to NICS and its delayed and insufficient responses to FBI inquiries create a risk of wrongful firearms transfers.”
It concluded, “This occurred because DHS has no oversight or policy to ensure compliance with NICS reporting requirements.”
One of the bigger issues was that criminal case information was not being transferred to the FBI’s NICS, which is a legal requirement.
On this issue, the IG report stated, “In particular, the components did not consistently update missing information on dispositions, that is, information on the nature and outcome of criminal proceedings.
“The components also did not always respond promptly or sufficiently to FBI NICS inquiries.
“DHS components took more than 3 days to respond or were unresponsive to 126 (59 percent) of 214 NICS inquiries.
“We attribute these issues to DHS not having a unified policy or plan to ensure the timely updating of dispositions or a mechanism to ensure prompt, sufficient responses to inquiries.”
The IG offered up four recommendations to address the situation, three of them specifically mentioning actions that need to be taken by Mayorkas.
The DHS has announced that it will put all four recommendations into play.
